Transparency v The Privacy of the Child

The Court of Appeal has just handed down its decision in Re M in which a freelance journalist sought access to the case papers for a complex set of care/placement order proceedings. Lady Justice King dismisses the appeal by the journalist against the judge’s order which balances the child’s article 8 rights to privacy against the press’s rights under article 10 to freedom of expression. Lady Justice King also highlights the President’s ongoing Transparency Review which is looking at the best way to resolve such maters whilst maintaining public confidence in the Family Court.
