A review of the most important and interesting cases of the last twelve months taking place on Frinday 3 November 2023 2 - 4 pm.

Led by barristers from Coram Chambers: Catherine Nicholes, Gill Honeyman and Anarkali Musgrave

Anarkali will talk about how to approach the two topics of competence and ascertainable wishes and feelings in cases when alienation is a feature.  This is in specific reference to Re C (child: ability to instruct a solicitor) [2023] EWCA Civ 889 and re A & B (no4) 2023.  Also, the case of Re GB [2023] EWFC 150 about who determines alienation is present in cases where it is a feature. 

Cathy will talk about the decision whether to instruct an expert or not, with a particular focus on psychiatric/psychological assessments, and how to select an expert. The talk will deal with how to proceed in light of Re C 2023 EWHC 345 and the statutory and other guidance. 

Cathy will also address practice issues arising when a decision has been taken not to hold a fact-finding hearing but family members continue to be affected by or refer to allegations of domestic abuse.

Gill will cover two shorter topics namely:

  1. A brief public law update to include DOLs/unauthorised placements, care orders with children at home and joinder of fathers without PR;
  2. Some of the changes resulting from implementation of Domestic Abuse Act 2021, focusing on 91.14 orders and QLRs.

The majority of the talks cross over between public and private law and will be of interest to practitioners who only do one or the other.
