 Dear Ms Shepherd 

PAYE AND NATIONAL INSURANCE DEDUCTIONS FROM 1 AUGUST 2001

I am writing further to your letter of the 6 July 2001, which was sent out with the contracts of employment to all self- employed guardians.   I refer to the statement made on page 4 of your letter in which you state that CAFCASS has been advised to make 'protective deductions' in respect of PAYE and National Insurance from 1 August 2001 from all self employed claims. 

We are taking legal advice on this matter.  In the meantime we would like to see the advice CAFCASS has received from its tax consultants and on which they intend to rely.  I would be obliged if you would send me a copy of this. 

In any event, NAGALRO intends to reserve its position and will advise its members to commence proceedings in their local county courts for all deductions for PAYE and National Insurance which has been made in this unilateral way by CAFCASS after 1 August.
